PRIVACY POLICIES
Qorex Group
General principles.
Qorex Group guarantees the protection of rights such as Habeas Data, privacy, intimacy, good name, image and autonomy, for this purpose all actions will be governed by principles of good faith, legality, computer self-determination, freedom and transparency.
Whoever, in the exercise of any activity, can provide any type of information or personal data to Mobile Gear Store, and in which it is acting as the person in charge of the treatment or responsible for the treatment, may know, modify or update it.
Qorex Group will keep in mind, at all times, that personal data is the property of the people to whom it refers and that only they can decide on it.
Qorex Group will guarantee the right of access when, after proof of the owner’s identity, making the respective personal data available to the latter, free of charge. Said access must be offered without any limit and must allow the owner the possibility of knowing and updating them.
This policy is framed in the provisions of the Political Constitution.
Definitions
Authorization: Prior, express and informed consent of the owner to carry out the processing of personal data.
Database: Organized set of personal data that is subject to Treatment.
Personal data: Any information linked or that can be associated with one or more specific or determinable natural persons.
Sensitive data: Those that affect the privacy of the owner, such as: racial or ethnic origin, political orientation, religious or philosophical convictions, membership in trade unions, social organizations, human rights, data related to health, life sexual and biometric data.
Person in charge of the treatment: Natural or legal person who performs the processing of personal data on behalf of the person responsible for the treatment.
Responsible for the treatment: Natural or legal person who decides on the database and/or the treatment of the data.
Holder: Natural person whose personal data is subject to treatment.
Treatment: Any operation or set of operations on personal data, such as the collection, storage, use, circulation or deletion.
Specific principles
The following specific principles will apply to the processing of personal data:
a) Principle of legality: The provisions in force for the processing of personal data and other fundamental rights will be applied.
b) Principle of security: Personal data will be protected to the extent that technical resources allow it, avoiding its adulteration, loss, consultation, and in general against any unauthorized use.
c) Principle of confidentiality: All persons who administer, handle, or have access to information found in Databases, undertake to keep strictly confidential all personal information received in the exercise of their functions. People who currently work or are linked in the future for this purpose, in the administration and management of databases, must sign another yes to their employment or service provision contract in order to ensure such commitment. This obligation persists and is maintained even after the end of their relationship with any of the tasks that comprise the Treatment.
d) Principle of freedom: Data processing can only be carried out with the prior, express and informed consent of the Owner. Personal data may not be obtained or disclosed without prior authorization, or in the absence of a legal, statutory, or judicial mandate.
e) Principle of veracity: The information must be truthful, complete, accurate, up-to-date, verifiable and understandable.
f) Principle of transparency: The processing of personal data must guarantee the Holder’s right to obtain information about the existence of any type of information or data of his or her interest.
g) Principle of purpose: The processing of data will serve a legitimate purpose, which must be informed to the respective owner of the personal data.
h) Principle of access and restricted circulation: Personal data, except for public information, may not be available on the Internet or other mass media, unless access is technically controllable.
Duties of Qorex Group, as responsible for the Treatment of Personal Data.
Qorex Group, when acting as Responsible for the Processing of personal data, will comply with the following duties:
a) Guarantee the Holder, at all times, the full and effective exercise of the right of habeas data.
b) Guarantee that the information provided to the data processor is truthful, complete, accurate, up-to-date, verifiable and understandable.
c) Keep the information under the necessary security conditions
d) Request and keep a copy of the respective authorization granted by the owner.
e) Duly inform the owner about the purpose of the collection and the rights that assist him by virtue of the authorization granted.
f) Inform at the request of the Owner about the use given to their data.
g) Update the information, communicating in a timely manner to the person in charge of the treatment.
h) Require the Treatment Manager at all times to respect the security and privacy conditions of the Holder’s information.
i) Rectify the information when it is incorrect and communicate what is pertinent to the person in charge of the treatment.
j) Process queries and claims made.
k) Provide the Person in Charge of Treatment, as the case may be, only data whose Treatment is previously authorized.
l) Inform the data protection authority when there are violations of security codes and there are risks in the management of information
Rights of the holders of the information.
The Holder of personal data has the following rights:
a) Access, know, rectify and update your personal data.
b) To receive information from Mobile Gear Store, upon request, regarding the use that has been given to your personal data.
d) Go before the legally constituted authorities and file complaints for violations of the provisions of the current regulations in the applicable regulations, after consulting or requesting the Treatment Manager.
e) Modify and/or revoke the authorization and/or request the deletion of the data.
Claims.
The Owner who considers that the information contained in a database should be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in the Law, may file a claim with the Data Controller.
Procedure to guarantee the right to file claims.
At any time and free of charge, the owner may request the Mobile Gear Store staff to rectify, update or delete their personal data, after proving their identity. This right may be exercised:
a) The owner, after proof of identity.
b) Your representative, prior accreditation.
The request for rectification, update or deletion must be submitted through the means enabled by Mobile Gear Store, indicated in the privacy notice and contain, at a minimum, the following information:
a) The name and address of the holder or any other means to receive the answer
b) Documents proving the identity of their representative.
c) The description of the personal data with respect to which the owner seeks to exercise any of the rights.
Data deletion.
The holder has the right, at all times, to request Mobile Gear Store, when he considers it so. This suppression implies the total or partial elimination of the personal information as requested by the owner.
It is important to bear in mind that the right of cancellation is not absolute and the person in charge can deny the exercise of the same when:
a) The owner who has a legal or contractual duty to remain in the database.
b) The elimination of data hinders judicial or administrative actions related to tax obligations, the investigation and prosecution of crimes or the updating of administrative sanctions.
c) The data that is necessary to protect the legally protected interests of the holder; to carry out an action based on the public interest, or to comply with an obligation legally acquired by the owner.
Data protection function within the company.
Qorex Group, designates the MARKETING unit, or the unit that acts in its place, as the person who will receive, process and channel the different requests that are received and must process the requests of the owners, in the terms, deadlines and conditions established by current regulations, for the exercise of the rights of access, consultation, rectification, updating, deletion and revocation that each person has on their personal data.
